General Subdirectorate of Resources and Relations with the Courts

The Sub-Directorate General for Resources and Relations with the Courts, attached to the Technical General Secretariat, performs the following functions:

• The processing and proposed resolution of administrative appeals filed against acts of the department and, in the absence of express attribution to another body, of its autonomous agencies.

• The processing and proposed resolution of claims of patrimonial responsibility against the department and, in the absence of express attribution to another body, those made against the public agencies attached to the Ministry, provided that its resolution corresponds to the owner of the department.

• The processing and proposed resolution of the procedures for ex officio review and declaration of invalidity, when they refer to acts of the department.

• The processing and proposed resolution of the procedures for exercising the right of petition.

• Relations with the courts and tribunals of justice, for the purpose of forwarding the files and documentation they request, receiving their notifications and preparing for the execution of their sentences, without prejudice to the provisions of the current regulations on representation and defence in the trial of the State and other public institutions.

• Likewise, the Office of the Attorney-General of the State-Directorate of the State Legal Service shall transmit to it the request for the exercise of legal proceedings before any court, at the request of the competent governing bodies on the basis of the matter.

• The follow-up of pre-judicial questions and litigation procedures with the European Union that affect the scope of the department’s competences, as well as the representation of the department in the commissions and bodies of an interministerial nature in relation to the Court of Justice of the European Union, when it is not expressly assigned to other governing bodies.
