The concept of Open Government refers to a new system of governance that promotes the participation of civil society as a mechanism to strengthen and increase democratic quality. One of its pillars is transparency, through which it is intended to generate trust, ensure accountability and facilitate the scrutiny of public actions by citizens.

Institutional information

Law 19/2013 on Transparency, Access to Public Information and Good Governance extends and strengthens the obligations of active publicity in different areas. In this sense, it requires the subjects within its scope of application to publish information regarding the functions they perform, the regulations that apply to them and their organizational structure, as well as their planning instruments and the evaluation of their degree of compliance.

Right of access

Law 19/2013 on Transparency, Access to Public Information and Good Governance establishes the obligation to publish all information that is most often the subject of a request for access, so that the obligations of transparency are connected with the interests of the citizens. Also, the decisions to deny and partially grant the public information requested, after dissociation of personal data, based on the causes indicated in point 1 of article 14 of the said Law.

Open Government

Open government is a culture of governance that promotes the participation of different actors in support of democracy. It is based on three pillars: transparency, participation and accountability.

Spain has been part of the Open Government Alliance since 2011 and has carried out several Open Government Action Plans, which act as a lever to achieve the sustainable development objective 16 of the 2030 Agenda: to build fair, peaceful and inclusive societies.

The Fourth Open Government Plan has launched an inclusive communication campaign of open government to inform and contribute to publicizing what is open government, publicizing the existence of the Transparency Portal and the existing mechanisms of participation in public life.

Open data

The publication of open data allows citizens to share valuable information from which a new added value can be obtained. Advantages of the publication of public data are: transparency; liberating the social and commercial value of data; promoting the participation and commitment of citizens.

The objective of the open data policy of the Ministry of Science, Innovation and Universities is to provide the data in its possession so that in an open way any citizen or company can exploit and reuse them, always complying with the conditions required by the applicable regulations.
