Communication of possible infractions affecting the central services of the Ministry of Science, Innovation and Universities.

Internal Channel

Law 2/2023, of February 20, regulating the protection of people who report on regulatory infractions and the fight against corruption, establishes the obligation for entities that make up the public sector to have a System or Internal Information Channel of the public entity, which is configured as the preferred way to channel communications on irregular practices, because it is preferable that the information be known as soon as possible by the organization itself so that it can correct or repair as soon as possible the damages.

In the event that your communication refers to possible irregularities carried out in public sector entities other than the central services of the Ministry, you must contact the System or Internal Channel of those entities, which can be found on the website of the corresponding entity.

External Channel

Based on Law 2/2023, there is additionally an System or External Information Channel to public entities, which in the scope of the General State Administration is the Independent Authority for the Protection of the Informant. It is recommended to use the external channel in cases where it is considered that there may be reprisals or that the communication may not be adequately attended to.

Protection of the Informant of the internal and external channels

Law 2/2023 aims to provide protection against reprisals that may be suffered by natural persons who report any of the actions or omissions referred to in article 2 of the Law. In this regard, both natural persons who communicate with the internal channel and those who communicate with the external channel have the right to the protection described in the Law, and to request it they must contact the Independent Authority for the Protection of the Informant (proteccioninformante.gob.es).

When communicating the information, it is advisable to provide any documentation or evidence that facilitates its verification. The information received will not be followed up when the scarcity of the information transmitted, the excessively generic and inconcrete description of the facts or the lack of evidence provided do not allow a reasonable verification of the information received and a minimum determination of the treatment to be given to the facts communicated.

A person who submits a communication has the right not to have his identity disclosed to third parties, although the identity may only be communicated to the judicial authority, the Public Prosecutor’s Office or the competent administrative authority within the framework of a criminal, disciplinary or punitive investigation.

The processing of personal data resulting from the application of Law 2/2023 will be governed by the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, in Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights, in Organic Law 7/2021, of 26 May, on the protection of personal data processed for the purposes of prevention, detection, investigation and prosecution of criminal offences and the execution of criminal sanctions.
