Technical General Secretariat

The General Technical Secretariat, attached to the Under-Secretariat, focuses its activities on the following:

• The elaboration and proposal of the normative plan of the department and the coordination and promotion of its implementation.
• The study, report and, where appropriate, elaboration of the normative projects that it is appropriate to dictate or propose to the department, as well as its administrative processing, with the exception of the procedures of public consultation, hearing of the interested parties and public information provided in article 26 of Law 50/1997, of 27 November, of the Government, which will correspond to the competent management centers.
• The preparation of reports on normative projects of other departments.
• The preparation, report and assistance to the holders of the Ministry, the State Secretariat for Science, Innovation and Universities and the Under-Secretariat for Science, Innovation and Universities in relation to matters to be submitted to the Council of Ministers, the Government Delegated Commissions and the General Commission of State Secretaries and Under-Secretaries.
• Actions related to the publication of administrative provisions and acts of the department and of the agencies and entities attached to it in the “Official State Gazette”.
• The actions derived from the participation of the department in the Commission for Follow-up of Provisions and Acts of the Autonomous Communities and the coordination of the actions of the different governing bodies of the department related to the transfer of functions and services to the autonomous communities.
• The processing and proposed resolution of administrative appeals filed against acts of the department and, in the absence of express attribution to another body, of its autonomous agencies.
• The processing and proposed resolution of claims of patrimonial responsibility against the department and, in the absence of express attribution to another body, those made against the public agencies attached to the Ministry, provided that its resolution corresponds to the owner of the department.
• The processing and proposed resolution of the procedures for ex officio review and declaration of invalidity, when they refer to acts of the department.
• The processing and proposed resolution of the procedures for exercising the right of petition.
• Relations with the courts and tribunals of justice, for the purpose of forwarding the files and documentation they request, receiving their notifications and preparing for the execution of their sentences, without prejudice to the provisions of the current regulations on representation and defence in the trial of the State and other public institutions.
• The follow-up of pre-judicial questions and litigation procedures with the European Union that affect the scope of the department’s competences, as well as the representation of the department in the commissions and bodies of an interministerial nature in relation to the Court of Justice of the European Union, when it is not expressly assigned to other governing bodies.
• The management of the attention to the citizen provided through the Citizen Information Center and the telematic services developed for this purpose.
• The functional coordination and publication of digital content on the web portal.
• The organization and management of the registration assistance offices of the department.
• The management of complaints and suggestions for the services provided by the department, through the Complaints and Suggestions Unit.
• The proposal of the editorial program of the department, the realization and edition of compilations, publications and other materials of the department and, where appropriate, their distribution and sale.
• The organization and direction of the libraries and documentation centers of the department.
• The exercise of the function of Transparency Information Unit of the department.
• The coordination of departmental initiatives in the field of open government.
• The coordination and supervision of the data protection policy in compliance with the applicable regulations in this field, within the competence of the department.
